Operating Rules

The rules are set up to ensure a good cooperation during the project. This way we can clarify each other's expectations and  responsibilities. To indicate your agreement with the Operation Rules, you will recieve the document with the Operating Rules at the beginning of an project and need to return them signed. 

1 \ Detailed project specifications

Following the first meeting, Batch Interior will draw up a project specification that clearly describes the project in its totality, including the start and end dates. If the project specification is modified, both parties, Batch Interior and the client, must sign the contract again.

2 \ Scope of work

The scope of all work will be specified in the project specification. This does not include the work of any contractor, architect, plumber, lighting or engineering contractor, or any changes and modifications to structural, plumbing, heating, electrical, air conditioning or ventilation systems at the project location. Work that may emerge during the project and of which the client wants Batch Interior to be in charge of, may be added to the contract under a subcontract. This sub-contract will be supplied by Batch Interior.

3 \ Communication

3.1 Communication

Batch Interior expects from the client an open communication line. If, during the project, problems arise, a personal situation arises or anything else that might interfere with the progress of the project, it is important that both Batch Interior and the client communicate this to each other. This to prevent appointments from not being kept or communication problems from occurring. Forgetting an appointment can happen to anyone but after two times Batch Interior will charge for the lost time.

3.2 Communication times

Batch Interior can be reached on working days between 10:00 am and 8:00 pm. Contact outside working hours is possible if this has been agreed on by both parties. In emergencies,

working hours are not taken into account, but depending on the responsibility of the emergency, Batch Interior can charge for the time captured. Batch Interior relies on the common sense of the client when assessing what constitutes an emergency. :) 

 

3.3 Communication channels

Batch Interior can be reached through Whatsapp business and can also be called through Whatsapp. Regular telephone calls are also possible.

4 \ Design and ownership of designs

4.1 Floor plan

Batch Interior is able to provide Project Site with a floor plan but this cannot be equated to an official blueprint. If the the client has a blueprint of the project location, a copy must be handed over with the agreement. If no blueprint of the location exists, the client must make the location available for Batch Interior to make. If the client cancels the order after measuring the plan, the client can buy the plan from Batch Interior at an agreed price based on the number of square meters of the project location.

 

4.2 Design

During the creation of the design Batch Interior will take the clients wishes and budget into account. Batch Interior. aims to pleasantly surprise its clients. Opening the eyes is an objective with which Batch Interior wants to show the client what else is possible. In doing so, Batch Interior asks the client to be open to the possibilities and to listen to the motives underlying them.

4.3 Ownership of designs

The designs made by Batch Interior will remain the property of Batch Interior at all times. When a project is completed, the client will have access to the designs and will have user rights. If the client publishes the designs, drawings, process photos, or photos of the completed project on his/her website, social media, communication channels or other public channels, Batch Interior must be notified and mentioned. This can be done by using the logo of Batch Interior on the photo or by mentioning ‘Design created by Batch Interior' in the text.

5 \ Confidentiality

Batch Interior is able to take leadership of the project during the process. This can vary in extent. Within this leadership we are not only talking about the work of Batch Interior but also about the work of other third parties within the project such as a construction worker.

 

5.1 Full leadership

When giving full leadership, a few things need to be arranged. Batch Interior must be given a set of keys so that she has access to the site at all times during the project. In addition, the client will have to sign off at various stages once the design has been established and at decision moments thereafter. This is to record the progress of the project. Batch Interior will take the lead in setting up the agreements and is the main communicator between Batch Interior de the client and the third parties. Despite full leadership, Batch Interior does not have full responsibility of the work of the third parties. If an incorrect action is taken by a third party that can be traced back to a communication failure on the part of Batch Interior, Batch Interior is responsible for this. But if the client, after having laid down the design, and when the development has already started by the third parties, makes a change in the design which results in unexpected costs or which extends the project

duration, not Batch Interior but the client will be held responsible for this. Batch Interior will be in charge of the budget within the entire leadership; the entire agreed budget will be

transferred to Batch Interior's account in advance. With the clients approval, Batch Interior will use this budget to make the expenditures necessary for the project. This budget does not include the agreed costs of the work by Batch Interior that the client will be responsible for.

5.2 Partial leadership

In case of partial leadership, Batch Interior may give instructions regarding the execution of the design to third parties and thus be present at the execution and the necessary agreements, but the full responsibility lies with the client. The budget remains under the clients control, Batch Interior will only provide advice for the execution within budget. The client will be responsible for the purchases and payment of products and third parties. 

 

5.3 No leadership

In this case Batch Interior will only provide a design to the client. However, Batch Interior may recommend other companies (third parties) for the required work if they are within Batch Interiors network. In this case the client is responsible for making contact with these third parties. Batch Interior is not responsible for the agreements and communication with the third parties concerning the realisation of the design. Furthermore, Batch Interior does not supervise the realisation of the project.

6 \ Conditions for contractual payment

For payment of the project, Batch Interior applies a 40% - 40% - 20% rule. This means that there are three payment moments at which the client will make a payment for the work of Batch Interior.

  • After signing the work contract, the client will transfer the first 40% of the total amount to the account number of Batch Interior After this, the design phase will start.

  • After the design phase and when the complete design has been determined, the client has to transfer the second 40% of the total amount to the bank account of Batch Interior After this, the realisation phase will start.

  • After completion of the realisation phase, taking of the final photographs and the total transfer of the project, the client will transfer the remaining 20% of the total amount to the bank account of Batch Interior After this, Batch Interior will hand over the paperwork, the drawings and a detailed book about the whole process to the client.

7 \ Purchase and return

7.1 Purchase

This section is subject to the degree of leadership of Batch Interior as discussed in section 5. Batch Interior will not place orders or make purchases for a customer until the full amount required is received. If not, this will be discussed and signed on the contract form prior to the project.

 

7.2 returns

Custom made products cannot be returned. For products supplied by third parties, Batch Interior follows the terms of delivery and returns of that particular third party. Independent of the degree of project leadership, the responsibility for returning products lies with the client.

8 \ Cancellation and refundable expenses

A cancellation is no fun for anyone, but to ensure that everything runs smoothly at this point, here are our conditions in writing. Batch Interior strives to maintain open communication despite the unpleasant outcome of such a situation, and to transfer the project completely and properly. There are two things that can happen, the client wants to cancel or Batch Interior wants to cancel.

 

8.1 If C. wants to cancel

If the client wishes to cancel the project after the contract has been signed, the hours made up to that point during the design phase will be charged at an hourly rate of €46.00 per hour excluding VAT. Batch Interior will provide an overview of the hours incurred, including activities, attached to the invoice. The client may at this time choose to purchase the drawings and other products already made. If the client cancels the project during the realisation phase, Batch Interior will charge for the hours made up to that point, based on an hourly rate of €46.00 per hour excluding VAT. If Batch Interior has full leadership, Batch Interior will refund the remaining budget and provide an overview of the costs incurred up to that point. Batch Interior will also forward all orders to the client and transfer the complete management. Batch Interior is not responsible in these cases for any miscommunication between third parties and the client or if the project is not delivered as previously foreseen.

8.2 If B.I. wishes to cancel

If Batch Interior wishes to cancel, the hours made up to that point will be charged by Batch Interior at a reduced rate of €42.00 per hour, excluding VAT. Batch Interior will provide an overview of the hours worked, including the activities, attached to the invoice. In this case Batch Interior will again hand over the entire project to the client. The client may at this time choose to purchase the drawings and other products already made. If Batch Interior has full leadership, Batch Interior will refund the remaining budget and provide an overview of the costs incurred up to that point. Batch Interior will also forward all orders to the client and transfer the complete management. Batch Interior is not responsible in these cases for any miscommunication between third parties and the client or if the project is not delivered as previously foreseen.

9 \ Insurance and liability

9.1 Products

When purchasing the products, the client may indicate whether he/she wishes to take out insurance on the products. If Batch Interior is in charge of the purchase of the products, it will inform the client of the possible insurances, but the closing of the insurance policy is the responsibility of the client.

9.2 Health insurance

Uninsured persons cannot be present at the project site for work on the project. This due to possible accidents that can happen. Batch Interior is not responsible for these accidents. During the construction phase, those who are present at the location must provide the necessary protection themselves: shoes with steel toecaps, work gloves and a construction helmet.

9.3 Third parties

Batch Interior can recommend third parties but is not responsible for the safety of these parties, the necessary protection and the checking of work permits and the necessary insurances.

10 \ Completion and photography

Upon completion of the project, Batch Interior will take photographs of the final result. The process, the drawings and the final photographs will be placed on the Batch Interior website. These photographs will be made regardless of whether Batch Interior has had leadership during the realisation. These are the realised designs of Batch Interior that are part of Batch Interiors portfolio.
